Terms of service

These terms are the agreement between your company and EKM ServiceFine, India ("we"), which runs NextIsWhat ("NIW"). By creating an account or using NIW, you accept them on behalf of your company. Please also read our privacy policy.

1. The service

NIW is an online app for managing sales and marketing: leads, contacts, companies, deals, next actions, campaigns, emails and reports. We may improve or change features over time; if we remove something important you pay for, we will tell you in advance.

2. Accounts

• The person who creates the company account is its owner and is responsible for who gets access and what they do in NIW.
• Keep passwords private. Tell us at once at privacy@nextiswhat.com if you think an account has been misused.
• Each login is for one person. Do not share logins.

3. Free trial

A new company gets a 14-day free trial, with no card needed. When the trial ends without payment, the account becomes read-only: everyone can still sign in, see and export the data, but nothing can be added or changed until you pay.

4. Price and payment

• Rs 1,000 per person per month, Sales and Marketing included. "Person" means each active login in your company.
• We are not registered for GST, so no GST is added.
• You pay in advance by UPI to EKM ServiceFine's account, writing your company ID in the payment note. Your paid period starts when we record the payment; if you pay before the current period ends, the new period starts when the current one ends, so no days are lost.
• If a payment is not made, the account becomes read-only, as after a trial. Your data is not deleted because of a missed payment.
• We will give at least 30 days' notice by email before any price change applies to you.

5. Your data

• Your company owns the data it puts into NIW. We use it only to provide the service, as described in the privacy policy.
• The owner can export the company's data at any time, including while the account is read-only.
• The owner can ask us to delete the company's data. It is hidden at once and removed within 30 days.
• You are responsible for having the right to keep and use the personal data you put into NIW, including your customers' details, under the Digital Personal Data Protection Act, 2023 and other laws.

6. Fair use

You agree not to:

• send marketing emails or messages to people who have not agreed to hear from you or who have unsubscribed, or send spam of any kind;
• put unlawful, harmful or misleading content into NIW, or use it to break any law;
• try to get into other companies' data, test or attack our security without our written permission, or overload the service;
• copy, resell or rebuild NIW.

We may set sensible limits (for example how many marketing emails go out per hour) to keep the service working for everyone. We may suspend an account that breaks these rules, after telling the owner where we reasonably can.

7. Availability and backups

We work to keep NIW running and take a backup every day, but we cannot promise the service will never be interrupted or free of faults. We may stop it briefly for maintenance, preferably outside Indian working hours.

8. Responsibility

NIW helps you organise work; decisions you make with it are yours. As far as the law allows, we are not liable for indirect losses such as lost profits or lost business, and our total liability for any claim is limited to the amount your company paid us in the 3 months before the claim.

9. Ending

You can stop using NIW at any time; simply do not renew. Payments already made are for the period they cover and are not refunded for unused days. We may end the service for a company with 30 days' notice, and we will let the owner export the data first.

10. Law

These terms are governed by the laws of India. If we change them, we will update the date at the top and tell company owners by email before an important change takes effect.
